Last week, U.S. District Judge Susan Dlott ruled that Northwest Local Schools erred in refusing to allow 5-year-old Keith Cordell to transfer to a new school on the grounds it would upset the school's 'racial balance.' Click here to read our earlier news story on this issue.
Sandra Tharp wanted to transfer her mixed-race son from Colerain Township, to a school closer to their day-care center. After applying Sandra received a letter from the school stating her son could not attend because 'Student does not meet eligibility criteria for the following reason: transfer will adversely affect racial balance of school.'
Judge Dlott's ruling, which called the district's policy unconstitutional said the district acted in good faith and did not intend to discriminate - points echoed by Robert B. Newman, attorney for Keith's mother - the judge said Northwest's policy failed a 2003 standard set by the U.S. Supreme Court in two University of Michigan admissions cases. The court ruled that racial quotas are impermissible, and that race cannot be the decisive factor in admissions.
Keith has now started at Northwest but the case is not yet finalised and although his mother sandra welcomed Judge Dlott's ruling she is now reconsidering her original decision due to new developments.
